1. Agreement to Terms
By accessing or using MissedCall, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
MissedCall provides an automated lead recovery service for UK trade businesses. The service automatically sends SMS messages to customers who call your business number when it is not answered, providing them with a link to submit their enquiry details.
3. Subscription and Pricing
- The service is provided on a monthly subscription basis at £49 per month
- Payment is processed securely through Stripe
- Subscriptions automatically renew each month unless cancelled
- You may cancel at any time with no cancellation fees
- No refunds are provided for partial months
4. Your Responsibilities
You agree to:
- Provide accurate business information during registration
- Set up call forwarding correctly on your phone
- Respond to customer enquiries in a timely manner
- Comply with all applicable laws and regulations
- Not use the service for spam or unsolicited messages
- Maintain the security of your account credentials
5. Service Requirements
- You must have a UK business phone number
- You must be able to configure conditional call forwarding on your phone
- Standard carrier call forwarding charges may apply
- The service requires an active internet connection to access your dashboard
6. Service Availability
While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We are not liable for:
- Missed calls due to technical issues outside our control
- SMS delivery failures caused by mobile network issues
- Customer's failure to set up call forwarding correctly
- Third-party service interruptions (Twilio, Stripe, etc.)
7. Data Usage and Privacy
Your use of the service is also governed by our Privacy Policy. We collect and process customer enquiry data on your behalf to provide the service.
8. SMS Compliance
You acknowledge that:
- SMS messages are sent on your behalf to customers who call your business
- Messages include an opt-out mechanism as required by UK law
- You are responsible for ensuring your use complies with UK telecommunications regulations
9. Intellectual Property
The MissedCall service, including all software, content, and trademarks, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the service.
10. Limitation of Liability
To the maximum extent permitted by law, MissedCall shall not be liable for:
- Any indirect, incidental, or consequential damages
- Loss of profits, revenue, or business opportunities
- Missed customer enquiries or lost jobs
- Damages exceeding the fees paid in the last 3 months
11. Cancellation and Termination
- You may cancel your subscription at any time through your Stripe billing portal
- Cancellation takes effect at the end of the current billing period
- We reserve the right to suspend or terminate accounts that violate these terms
- Upon termination, your data will be deleted after 30 days
12. Changes to Terms
We may modify these terms at any time. We will notify you of significant changes via email. Continued use of the service after changes constitutes acceptance of the new terms.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
